Gruesome but Necessary

I'm working on my will because naming a guardian for my kids has been on my mind for a long time now. Not so much the naming but the preparing of the documents to make it all nice and legal and binding. It's been well over a decade since I took Estates and Trusts in law school and so I'm just surfing around for (free) samples of wills before I decide on what I'm going to cobble together. FYI, www.nolo.com is THE BEST when it comes to explaining legal stuff in non-legalese. One of the ISNA-sponsored ones contains this gem:

Should I die as a result of murder, I direct that the adjured murderer, principal or accessory in the murder shall be disqualified to receive any part of my estate.

I sooo want to add a "DUH!" to the end of that provision. Maybe I'll include it in the addendum. Consider yourself warned! If you murder me, you absolutely positively will NOT get your bloody mitts on my Buffy, The Vampire Slayer Series DVDs.

would you believe that i was actually considering you as a runner up (you are supposed to list multiple options in case someone kicks the bucket before you)? i wasn't sure if you'd be happy or run away screaming in terror.

actually this is based on a real case. Most states specifically have laws that disallow a murderer from receiving their inheritance, and I think many wills put it in their as a backup. Basically I think some son killed their dad, and then when he was in jail, he sued to get his share. Court said um, NO, you jackmonkey.

abz - well, with this wild and crazy lifestyle i lead, you never know. ;) i would just be so annoyed if i bit the dust and, despite being a lawyer, didn't have a will to leave behind or arrangements for my beasts.

soph - most states but not all, eh? i wonder which ones don't and why. i bet they are the same ones that make it illegal to walk your donkey on the streets on a sunday.

By most states i meant all. And i only know this junx because i studied for and passed two bar exams in the past year. Well, three if you count the patent bar. But there's nothing about wills in there.
